These are the terms and conditions on which we, Gym X Store, supply our products to you through our website in India. Please read them carefully before placing an order.
 
1. Who We Are and How to Contact Us
1.1 Who we are: We are Gym X Store, a fitness apparel brand based in India, owned and operated by TECHIKE SOLUTIONS LLP, registered under Indian laws with our principal office at Ahmedabad. Gujarat 382350, India.

1.3 How we contact you: We will contact you via the email or phone number provided in your order.

2. Placing an Order
2.1 Orders can be placed on our website or app by selecting items, entering your contact, delivery, and payment details, and confirming the purchase.
2.2 Our acceptance of your order occurs once we confirm dispatch. A legally binding contract will then exist.
2.3 Once we confirm dispatch of your item(s) via email or SMS, your order is considered accepted and a binding contract is formed between you and us.
2.4 You must be at least 18 years old or have parental/guardian supervision to place an order.

3. Cancelling Orders
3.1 We may cancel your order if items are out of stock, your payment is not verified, or if we suspect misuse of our platform.
3.2 We reserve the right to cancel or reject any order without prior notice if it breaches our policies or if fraudulent or suspicious activity is detected.
3.3 If you wish to cancel your order before dispatch, please contact our support team immediately. If the order is already shipped, you may initiate a return after delivery as per our Return Policy.
3.4 In case we cancel your order after payment is made, a full refund will be issued to your original payment method.

4. Products
4.1 Our offerings include gymwear and related accessories.
4.2 Product images are for reference only. Colours and appearance may vary depending on your screen/display.
4.3 Products like underwear, bottles, shakers, or any items opened/unsealed cannot be returned due to health, safety, and hygiene concerns.
4.4 We reserve the right to refuse returns if the product appears used, worn, or not in resalable condition.
4.5 We may revise or discontinue products without notice and are not liable for any unavailability.

5. Delivery
5.1 We deliver across India using trusted courier services.
5.2 Delivery charges and estimated timelines are shown at checkout.
5.3 We are not responsible for delays due to courier or external issues (e.g. weather, strikes).
5.4 If you are unavailable at the time of delivery, our courier partner will contact you or attempt redelivery.
5.5 Title and risk for the products pass to you upon delivery.

6. Returns & Refunds
6.1 You may request a return or exchange within 10 days of receiving your item, provided it is unused, unwashed, and in original packaging with tags. During promotional periods, this may extend up to 15 days.
6.2 Returns are not accepted for:

• Innerwear, socks, or items related to hygiene

• Used, washed, or damaged items

• Customised or discounted (final sale) products

• Products with care labels or tags removed

• Items not returned in original condition with all parts

6.3 Refunds will be processed within 7–14 working days after receiving the returned item and verifying its condition.
6.4 Refunds will be issued to the original payment method only.
6.5 If we find any abuse of our return system, we reserve the right to decline further returns or exchanges.

7. Pricing & Payment
7.1 Prices are listed in INR (₹) and inclusive of GST unless stated otherwise.
7.2 We accept payment via UPI, debit/credit cards, net banking, and select wallets. EMI options may be provided via Razorpay/PayU if enabled.
7.3 In case of pricing errors or system glitches, we reserve the right to cancel affected orders and issue refunds.
7.4 We reserve the right to modify prices, offers, or product availability without prior notice.

8. Discount Codes
8.1 Discount codes are valid for a limited time and can be used only on non-discounted items.
8.2 One code per order. Offers may be revoked or changed without notice.
8.3 If you return a discounted order, your refund will be based on the discounted price.
8.4 Discount codes cannot be exchanged for cash and may be restricted by territory, usage count, or minimum order value.

9. Our Liability
9.1 We are not responsible for indirect, incidental, or consequential damages.
9.2 Our maximum liability is limited to the amount paid for the product(s).
9.3 Nothing in these terms affects your statutory rights under Indian consumer protection laws.
9.4 We are not responsible for any third-party service issues such as payment gateway downtime or courier delays.

10. Privacy
We only use your personal data in accordance with our Privacy Policy. By shopping with us, you agree to this usage.
11. Governing Law & Dispute Resolution
11.1 These terms are governed by the laws of India.
11.2 Any disputes shall be subject to the exclusive jurisdiction of courts located in [Insert City, e.g. Mumbai or Ahmedabad].
11.3 We may opt for online arbitration or mediation to resolve customer disputes efficiently.
11.4 Any dispute or claim will first be attempted to be resolved through negotiation or online mediation. If unresolved, it shall be referred to a sole arbitrator appointed under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be ahmedabad, India, and the language shall be English.
11.5 You agree to waive any rights to file class action or representative proceedings. All disputes will be handled individually.

12. General Terms
12.1 We may revise these terms without prior notice. The version shown on the website at the time of your order will apply.
12.2 If any term is deemed invalid by law, the remaining terms shall remain enforceable.
12.3 You may not transfer your rights under these terms without our written consent.
12.4 We may transfer our rights and obligations under these terms to another organisation. You will be informed in such case, and may cancel your order if you do not agree.
12.5 Continued use of our website/app signifies your agreement to the latest version of these terms.
